About the Webinar: (Eligible for 1.0 hours MCLE credit.) Grasping the assignability of construction contracts is complicated and requires understanding the complex intersection of judge-made law, contract and statutory law, and equity. This presentation will address the basics for assigning construction contracts and claims, and the most common assignment-related quirks that affect construction practitioners. The presentation and materials will address: (1) traditional assignment under contract law; (2) liquidating agreements and pass-through claims; (3) equitable subrogation; (4) statutory schemes that govern assignment of construction claims; (5) prohibitions or limitations on assigning contracts or claims; (6) statutes of limitations on assigned claims; and (7) determining the damages recoverable by the assignee.
Presented by: Will Allensworth | Allensworth Law | Austin, Texas
Co-Sponsored by the Construction Law Foundation of Texas & The Construction Law Section of the State Bar of Texas
